1. Information we collect
Information you give us
We collect information you provide when you fill out a form, book a call, request investor access, subscribe to emails, become a client, apply for a job, or otherwise contact us. Depending on the interaction, this may include:
- Contact details: name, email address, phone number, mailing address, company name, job title, and website.
- Inquiry details: the services you are interested in, your goals, budget, timeline, and anything else you choose to tell us.
- Investor details (Invata Global Capital): whether you are an accredited investor, investment interests, and, if you proceed with an offering, the information required to verify your identity and eligibility, as described in section 5.
- Client and billing details: information needed to provide services and get paid, such as billing contacts and invoices. Card and bank payments are processed by our payment processors (for example, Stripe); we do not store full card numbers.
- Communications: the content of emails, messages, call notes, and recordings of calls or meetings where you have been told the call is recorded.
Information collected automatically
When you visit the Websites, our hosting, security, and analytics providers automatically collect technical information such as your IP address, browser and device type, operating system, language, referring page, pages viewed, links clicked, and the date and time of your visit. We may derive an approximate location (city or region) from your IP address. We do not collect precise geolocation.
Information from other sources
We may receive information about you from business partners, referral sources, event organizers, publicly available sources (such as company websites and professional profiles), and service providers that help us verify investor eligibility or prevent fraud.
Sensitive information
We do not ask for sensitive information through our general forms. If you take part in an investment offering, we may need government-issued identification and financial information to meet legal requirements; we collect it only for that purpose and handle it as described in section 5.
2. How we use information
We use personal information to:
- Respond to your inquiries, schedule calls, and provide the services you request.
- Evaluate and manage investor relationships, including confirming eligibility for private offerings (Invata Global Capital).
- Deliver, manage, and bill for client projects (Invata Global Marketing).
- Send administrative messages, such as confirmations, updates, and changes to our terms or policies.
- Send marketing emails or texts where you have agreed or where the law otherwise allows, and measure how they perform.
- Operate, maintain, secure, and improve the Websites, including analytics, troubleshooting, and preventing spam, fraud, and abuse.
- Show relevant advertising and measure its effectiveness, subject to your choices described in section 4.
- Comply with legal, tax, accounting, and regulatory obligations, and establish, exercise, or defend legal claims.
- Carry out a merger, acquisition, financing, or sale of all or part of our business.
Some of our service providers use artificial intelligence tools, for example to help summarize inquiries, draft replies that our team reviews, or analyze website performance. They process information on our behalf and under our instructions. We do not use personal information to make decisions that produce legal or similarly significant effects about you solely by automated means.
If you are in a region that requires a legal basis for processing (such as the European Economic Area or the United Kingdom), we rely on your consent, the performance of a contract with you, our legitimate interests in running and growing our businesses, or compliance with legal obligations, as applicable.
3. How we share information
We share personal information only as described below:
- Within Invata Global: among Invata Global Enterprises Inc. and its companies, so the right team can respond to you. Each follows this policy.
- Service providers: companies that help us run our business, such as website hosting and security, email delivery, customer relationship management, scheduling, analytics, payment processing, accounting, cloud storage, and identity or accreditation verification. They may use the information only to provide services to us.
- Advertising and analytics partners: if we use analytics or advertising cookies and pixels, those partners may receive technical information about your visit. See section 4 for your choices.
- Professional advisors: lawyers, accountants, auditors, fund administrators, and insurers, under duties of confidentiality.
- Legal and safety: when required by law, subpoena, or court order, or when we believe disclosure is necessary to protect the rights, property, or safety of Invata Global, our clients, investors, or others.
- Business transfers: in connection with a merger, acquisition, financing, reorganization, or sale of assets, subject to standard confidentiality protections.
- With your consent or at your direction.
We do not sell personal information for money. We do not share mobile phone numbers or text-messaging opt-in information with third parties or affiliates for their own marketing purposes.
4. Cookies, analytics, and advertising
We use cookies and similar technologies to operate and secure the Websites, understand how they are used, and, where we run advertising, measure and improve it. Our Cookie Policy explains the types we use and how to control them.
Under some U.S. state laws, using advertising cookies or pixels to show you ads on other websites may be considered “selling” or “sharing” personal information, or “targeted advertising.” You can opt out at any time by:
- Turning on Global Privacy Control (GPC) in a browser or extension that supports it. We treat a GPC signal as a request to opt out for that browser.
- Emailing legal@invataglobal.com with the subject “Opt out.”
- Using the industry opt-out tools at optout.aboutads.info and optout.networkadvertising.org.
Many browsers also offer a “Do Not Track” setting. Because there is no common standard for it, we do not respond to Do Not Track signals, but we do honor GPC as described above.
5. Investor information (Invata Global Capital)
Information on invataglobalcapital.com is not an offer to sell, or a solicitation of an offer to buy, any security. When you request investor access, we use your information to contact you, understand your investment interests, and determine whether you may be eligible for a private offering.
If you choose to invest, we and our service providers (such as fund administrators, verification services, banks, and legal counsel) may collect and process identification, contact, tax, financial, and accreditation information to verify eligibility, meet anti-money-laundering and know-your-customer requirements, process subscriptions and distributions, and provide investor reporting. That information is governed by this policy and by the confidentiality terms of the applicable offering documents, and we keep it as long as required by securities, tax, and other laws.
6. Email and text messages
Email. You can unsubscribe from marketing emails at any time using the link in any marketing email or by contacting us. We may still send transactional and service messages, such as replies to your requests, project communications, and investor notices.
Text messages. If you opt in to receive text messages from us, message frequency varies and message and data rates may apply. Reply STOP to cancel or HELP for help. Consent to receive marketing texts is not a condition of any purchase or service.
7. How long we keep information
We keep personal information only as long as needed for the purposes in this policy, including to provide services, maintain business records, resolve disputes, and meet legal, tax, accounting, and regulatory requirements. As a general guide:
- Inquiries and prospect information: up to three years after our last interaction, unless you become a client or investor.
- Client records: for the length of the relationship and up to seven years after it ends.
- Investor records: for as long as required by securities, tax, and anti-money-laundering laws and the applicable offering documents.
- Website logs and analytics data: generally up to 26 months.
When we no longer need information, we delete or de-identify it. If that is not immediately possible (for example, in backups), we store it securely and isolate it from further use until deletion is possible.
8. How we protect information
We use administrative, technical, and physical safeguards designed to protect personal information, including encrypted connections (HTTPS), access controls, multi-factor authentication on key systems, and service providers with appropriate security commitments. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. Please do not send sensitive information, such as Social Security or account numbers, through our website forms or by regular email.
9. Your privacy rights
Depending on where you live, you may have some or all of the following rights regarding your personal information:
- Access: confirm whether we process your information and get a copy of it.
- Correction: correct inaccurate information.
- Deletion: ask us to delete information we hold about you.
- Portability: receive certain information in a portable format.
- Opt out: of targeted advertising, “sales” or “sharing” of personal information, and profiling in furtherance of decisions with legal or similarly significant effects.
- Limit or consent: to the use of sensitive personal information, where the law provides this right.
- Withdraw consent where we rely on it, and object to or restrict certain processing (for example, in the European Economic Area and the United Kingdom).
These rights are provided by laws such as the California Consumer Privacy Act (as amended by the California Privacy Rights Act) and the comprehensive privacy laws of other U.S. states, as well as the GDPR and UK GDPR where they apply. Rights and exceptions vary by law, and some laws apply only to businesses above certain size thresholds; we will honor requests as required by the law that applies to you.
How to make a request
Email legal@invataglobal.com with the subject “Privacy request” and tell us which right you want to exercise and which Invata Global company you dealt with. We will confirm receipt and respond within the time the law requires (generally 45 days in the U.S., which may be extended where permitted). We will verify your request by matching information you provide with information we hold. You may use an authorized agent; we may ask for proof of the agent’s authority and to verify your identity directly.
If we deny your request, you may appeal by replying with the subject “Privacy appeal.” We will respond to appeals within the time required by law. If your appeal is denied, you may contact your state attorney general or data protection authority.
We will not discriminate against you for exercising your privacy rights.
Notice for California residents
In the past 12 months, we have collected the following categories of personal information: identifiers (such as name, email, phone number, and IP address); customer records information (such as contact and billing information); commercial information (such as services requested or purchased); internet or other electronic network activity (such as pages viewed); approximate location derived from IP address; professional information (such as company and job title); and, for investors who proceed with an offering, financial and identification information needed for eligibility and compliance (which may include sensitive personal information used only for those purposes). We collect this information from the sources described in section 1, for the purposes described in section 2, and disclose it to the categories of recipients described in section 3. We retain it as described in section 7.
We do not sell personal information for money. If we use advertising cookies or pixels, that may be considered “sharing” for cross-context behavioral advertising, which you can opt out of as described in section 4. We do not knowingly sell or share the personal information of consumers under 16. We use sensitive personal information only for purposes permitted by law, such as verifying investor eligibility and complying with legal obligations.
California residents may also request information about disclosures of personal information to third parties for their direct marketing purposes under California Civil Code section 1798.83 (“Shine the Light”). We do not disclose personal information to third parties for their own direct marketing purposes.
10. International visitors
We are based in the United States, and our Services are intended for people in the United States. If you visit from another country, your information will be transferred to, stored, and processed in the United States and other countries where our service providers operate, which may have different data protection laws than your country. Where required, we use appropriate safeguards, such as standard contractual clauses, for these transfers. Residents of the European Economic Area, the United Kingdom, and Switzerland may also lodge a complaint with their local data protection authority.
11. Children
Our Services are intended for adults and are not directed to children. We do not knowingly collect personal information from children under 13 (or under 16 where a higher age applies). If you believe a child has given us personal information, contact us and we will delete it.
12. Changes to this policy
We may update this Privacy Policy from time to time. When we do, we will change the “Last updated” date at the top. If we make material changes, we will provide additional notice, such as a notice on our Websites or an email, before the changes take effect where required by law.
